I'm guessing that the "unreasonable" part of the Fourth will be at the heart of this debate, along with more practical considerations of bias and profiling. (Lots of things can be made to seem "reasonable" in the face of a vague threat; see the Patriot Act, the Alien and Sedition Act, etc etc)
